TERMS OF SERVICE

By commissioning me you agree to these terms of service.
I retain the right to alter these terms at any time.
As the artist, I will adhere to this ToS very strictly.
To not read this ToS means that you as the client are willing to be unaware of your protections
as a client and mine as the artist. Therefore there is no excuse to be surprised by my strict
adherence to this ToS.
Artist Rights
● I retain full rights to my artwork. This entails the right to use said artwork in: my public
galleries, selling prints and adding them into artbooks. I will ask the character owner
before making additional profit off the art piece featuring their character.
● If a client wants to keep a commission private, therefore not having it uploaded to my
galleries, the request needs to be made before payment has been sent. Additional fees
may be added.
● I reserve the right to use rejected sketches, thumbnails and the like for future works and
YCH auctions.
● I reserve the right to reject and cancel commissions at any point in time due to my own
discretion, a full refund will be issued in this case.

Client Rights
● Commissions are made for non-profit/non-commercial use.
● Clients retain the right to use the high resolution file in the following ways:
○ Any non-profit use: like making personal prints, posters, merch, using as
banners/backgrounds and sharing non-publicly.
○ Uploading the high res file to online galleries and social media posts as a
standalone piece.
○ Signature is not removed.
● Clients retain the right to use the low resolution file (commonly labeled “WebRes”) in the
following ways:
○ Any non-profit use: like icons, banners, emotes, honestly whatever y’all can think
of.
○ Posting and sharing to online galleries and sites publically.
○ When posting and sharing the art piece, the client is required to provide proper
credits. Therefore supplying a link to, at least, one of my galleries when
applicable and spelling my name correctly.
○ Signature and watermark is not removed.
● Overall, clients are not allowed to edit (or have another artist edit) the artwork.

Payment & Refunds
● By commissioning me you are paying for my current art skills at the time.
● Payment and prices are always in USD.
● Payment plan options are not granted for commissions.
● The first half of the price is paid after the accepted sketch. The other half is made after the lineart.
● YCH payments are made up front and are not refunded no matter what.
● Full refunds are only given if I cancel the commission for my own reasons.

Work Process, Adjustments and Edits
● Clients have within 7 days of receiving their commission to ask for an adjustment or fix.
Beyond that I am no longer obligated to work on the commission any longer.
● I only provide work in progress (WIP) as a sketch, lineart and flat colors to accept.
● By commissioning me you approve of any slight color variances of your character. I do
not tend to render characters in exact colors provided by references because I take into
account multiple variables such as: lighting, atmosphere and prioritize the composition
as a whole.
● That being said, if the character colors are completely and noticeably off, a case can be
made to have a free adjustment or fix.
● I can only grant free adjustments and fixes if I was provided with a comprehensive
character reference page. Example 1, Example 2
● I only grant free adjustments and fixes if the correct information was made explicit in
the reference material I was given. Therefore the mistake was essentially a fault on my
part.
● Client is paying for my skill at the time of commissioning me. Therefore I do not provide
free fixes for client-perceived anatomical / lighting / shading errors.
● The lineart can be changed only before coloring. When I start working on the colors
and the client accepted the lineart I will not provide fixes.

Deadlines + Updates
● By default a commission should be completed within 40 days of payment, unless
otherwise stated. While commissioning ask about the que and time.
● If a client requests a deadline an additional fee may be added. This is up for discussion.
● The way I prioritize my commissions are not always first-come-first-serve. This is
sometimes specified when I open commissions.
● Commission status and updates are constantly being updated on my Trello page.
However, if a client has any extra questions, requests and or updates you may contact
me fastest on Twitter or Telegram. You can also email me kacper.rygallo@gmail.com but I am
much slower at answering emails. When asking questions, please include the actual
question and all relevant info in the message. This helps me answer questions faster.
● Please keep update inquiries at a minimum. If there has been no changes on trello, it is
likely that I have nothing new to report.

Other Notes
● I am to be treated with respect and as a fellow human being.
● However, I am still running a business, therefore I expect a certain level of
professionalism during the commissioning process. This involves:
○ Reading and comprehension. I often will not work with clients who display an
attitude where they cannot be bothered to read two sentences of information
pertaining to what they’re spending their money on.
○ Alternatively, reading this ToS is for the client’s benefit and I do not expect
everyone to read it in its entirety, especially in regards to smaller commissions.
○ Using proper English. if English is not your first language I just ask that you try
your best.
○ Overall communication. If you no longer want a commission, have a question, or
anything please communicate these things to me explicitly.
If you have any questions pertaining to this ToS please feel free to ask.
Like I’ve already mentioned, I do not expect every client to read the ToS in its entirety. The ToS
exists as a point of reference to protect myself and my clients. To not read this ToS means that
you as the (future) client are willing to be unaware of your protections as a client and mine as
the artist. Therefore there is no excuse to be surprised by my strict adherence to this ToS.
